Court of Appeal confirms Joyce Bagala as Mityana woman MP

The Court of Appeal has confirmed Joyce Bagala as the duly elected Woman Member of Parliament for Mityana District.

Bgala (NUP), floored incumbent and Lands Minister Judith Nabakooba(NRM) in the January 2021 election but the latter challenged the victory in court.


Consequently, the High Court in Mubende ruled in Nabakooba’s favor. The court agreed with the petitioner that the January 14 polls had been marred by voter bribery, multiple voting committed by Bagala or her agents and thus, the presiding judge ordered for a fresh election after throwing Bagala out of parliament.

The former head of News at Nbs TV however appealed the decision.

Three justices of the Appeal Court including Geoffrey Kiryabwire, Stephen Musota and Christopher Gashirabake Friday concurred with Bagala and Electoral Commission’s lawyers that the lower court’s ruling was made in error.

The justices said that the onus to prove the effect of the said non-compliance on the outcome of the election lay on Nabakooba’s side but noted this was not done.

The court didn’t however condemn the Minister to pay costs incurred by Bagala during the case which the MP described as unfortunate.
